1. Acceptance of Terms
By accessing and using the services provided by Ocean Trail Co., you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use our services. These terms apply to all visitors, users, and participants of our guided coastal hiking tours and related services.
Ocean Trail Co. reserves the right to change these terms at any time without prior notice. Your continued use of our services following the posting of changes to these terms will mean you accept those changes.
2. Service Description
Ocean Trail Co. provides guided hiking tours along Australia's scenic coastal paths and nature reserves. Our services include but are not limited to:
- Guided coastal cliff adventures
- Nature reserve exploration tours
- Beach and rock pool educational tours
- Photography expeditions
- Specialized workshops including marine ecology, coastal photography, and bushcraft training
- Equipment provision and safety briefings
All tours are conducted with professional safety standards and eco-friendly practices. We maintain small group sizes to ensure personalized attention and minimal environmental impact.
3. Booking and Payment Terms
All bookings must be confirmed with full payment or an agreed deposit. Prices are subject to change without notice, but confirmed bookings will honor the agreed price. Payment can be made through our secure online booking system or by contacting our office directly.
Group discounts may apply for bookings of five or more participants. Corporate and educational group rates are available upon request. Special event bookings, including private tours and workshops, require advance booking and may have different terms.
All prices are listed in Australian dollars (AUD) and include GST where applicable. Additional charges may apply for specialized equipment rental or extended tour durations.
4. Cancellation and Refund Policy
Cancellations made 72 hours or more before the scheduled tour will receive a full refund minus a 10% processing fee. Cancellations made between 24-72 hours before the tour will receive a 50% refund. Cancellations made less than 24 hours before the tour are non-refundable.
Ocean Trail Co. reserves the right to cancel tours due to weather conditions, safety concerns, or insufficient bookings. In such cases, participants will receive a full refund or the option to reschedule at no additional cost.
No refunds will be provided for participants who fail to arrive at the designated meeting point on time or who are unable to complete the tour due to personal reasons, fitness limitations, or failure to follow guide instructions.
5. Health and Safety Requirements
All participants must be in reasonable physical condition appropriate for the chosen tour. Participants with pre-existing medical conditions, injuries, or physical limitations must inform Ocean Trail Co. at the time of booking. We reserve the right to refuse service to individuals who we determine may be at risk or may endanger others.
Participants must follow all safety instructions provided by our guides. Failure to comply with safety guidelines may result in removal from the tour without refund. All participants are required to wear appropriate clothing and footwear as specified in our pre-tour communications.
Participants under 18 years of age must be accompanied by a parent or guardian, or have written consent. Special youth programs may have different age requirements and supervision ratios.
6. Liability and Risk Acknowledgment
Participants acknowledge that outdoor activities carry inherent risks including but not limited to: uneven terrain, weather conditions, wildlife encounters, and physical exertion. Ocean Trail Co. takes all reasonable precautions to ensure participant safety but cannot eliminate all risks associated with outdoor activities.
By participating in our tours, you acknowledge these risks and agree that Ocean Trail Co., its employees, and agents shall not be liable for any injury, loss, or damage arising from your participation in our activities, except where such liability cannot be excluded by law.
Participants are strongly encouraged to have appropriate travel and medical insurance. Ocean Trail Co. is not responsible for medical expenses, evacuation costs, or other expenses resulting from injury or illness during tours.
7. Environmental Responsibility
Ocean Trail Co. is committed to sustainable tourism practices. Participants are expected to follow Leave No Trace principles and respect all natural environments visited during tours. This includes staying on designated trails, properly disposing of waste, and not disturbing wildlife or vegetation.
Photography of sensitive areas may be restricted to protect wildlife and preserve natural environments. Participants must comply with all local environmental regulations and protected area guidelines.
8. Privacy and Data Protection
Ocean Trail Co. collects and processes personal information in accordance with our Privacy Policy. By using our services, you consent to the collection and use of your information as described in our Privacy Policy. We are committed to protecting your privacy and maintaining the confidentiality of your personal information.
Photography and filming may occur during tours for promotional purposes. Participants will be informed of such activities and may opt out if they prefer not to be included in marketing materials.
9. Intellectual Property
All content on the Ocean Trail Co. website, including but not limited to text, graphics, logos, images, and software, is the property of Ocean Trail Co. and is protected by copyright and other intellectual property laws. Unauthorized use, reproduction, or distribution of our content is prohibited.
Participants retain ownership of their personal photographs and videos taken during tours, but grant Ocean Trail Co. permission to use such materials for promotional purposes unless specifically requested otherwise.
10. Force Majeure
Ocean Trail Co. shall not be liable for any failure to perform its obligations under these terms if such failure results from circumstances beyond our reasonable control, including but not limited to natural disasters, extreme weather conditions, government restrictions, or other acts of nature.
In such circumstances, we will make reasonable efforts to provide alternative arrangements or reschedule tours when possible.
11. Dispute Resolution
These terms are governed by the laws of New South Wales, Australia. Any disputes arising from these terms or your use of our services will be resolved through binding arbitration in accordance with Australian commercial arbitration rules.
Both parties agree to attempt to resolve any disputes through good faith negotiations before pursuing formal legal proceedings.
